Terms of Service

1. Acceptance of Terms

By accessing or using Suki POS or Suki Perks (collectively, "the Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Services.

These terms constitute a legally binding agreement between you and MONOSPHERE SOFTWARE DEVELOPMENT SERVICES ("Monosphere," "we," "our," or "us").

2. Description of Service

Suki provides point-of-sale (POS) software for merchants and a customer loyalty application (Suki Perks). The POS app enables merchants to process transactions, manage inventory, and oversee store operations. Suki Perks allows customers to earn and redeem loyalty points at participating merchants.

3. Account Registration

To use the Services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including any PINs used for point-of-sale access.

You agree to notify us immediately of any unauthorized use of your account. Monosphere is not liable for any loss arising from unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Services or related systems
• Interfere with or disrupt the integrity or performance of the Services
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to transmit harmful, fraudulent, or misleading content

5. Billing and Payment

Suki POS uses a credit-based billing model. Transaction credits are purchased through in-app billing via the Apple App Store or Google Play Store. Each completed sale consumes one transaction credit.

Credits do not expire once purchased. Refund policies follow the respective app store guidelines. New accounts receive a complimentary trial period with free transaction credits.

6. Intellectual Property

Suki, the Suki logo, Suki POS, Suki Perks, and all related trademarks, service marks, and logos are owned by Monosphere. The Services, including all content, features, and functionality, are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent.

7. Data and Privacy

Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Services, you consent to the data practices described in the Privacy Policy.

8. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms of Service or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties.

You may stop using the Services at any time. Upon termination, your right to use the Services will cease immediately. Sections relating to intellectual property, limitation of liability, and governing law will survive termination.

9. Limitation of Liability

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Monosphere shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claim arising from these terms or the Services shall not exceed the amount you have paid to us in the twelve months preceding the claim.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms and revising the "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised terms.
